SB128 Summary

• State Forester authorized to sell surplus vehicles, equipment, and personal property owned by the Alabama Forestry Commission either at public auction or through negotiated sale to other state departments, agencies, or political subdivisions.

• Public auction sales must be advertised for at least two consecutive weeks on the Alabama Forestry Commission website, with property descriptions, inspection times, and auction details; property must be available for inspection at least 48 hours before sale.

• All bids at public auction must be publicly opened, with successful and unsuccessful bids placed on public record; payment required at time of bid acceptance using cashier's check, certified check, U.S. currency, or notarized bank letter, with 7-day removal requirement.

• Sales made in violation of this act are void and subject to liquidated damages between $1,000 and $10,000, recoverable by the Attorney General through civil action in Montgomery County Circuit Court with funds deposited to the State General Fund.

• All proceeds from sales deposited into the Alabama Forestry Commission Fund in State Treasury for use by the Commission; act becomes effective on the first day of the third month following passage and approval.
