• Amends Alabama Code Section 36-12-41 to modernize language regarding public records requests and clarifies that public records do not include records of the judicial branch of state government.

• Establishes formal procedures for requesting public records through hand delivery, mail, or electronic means if the public officer has a written process for accepting electronic requests.

• Requires public officers to acknowledge receipt of requests within 10 business days and respond to requests within 20 business days with one of six possible responses: providing access, estimating costs, denying in full, denying in part, identifying the actual custodian, or stating the record does not exist.

• Provides a standard form template for written public records requests that includes requester contact information, agency name, date of request, and specific description of requested records.

• Becomes effective October 1, 2023; allows public officers to deny creation of new records that do not already exist and protects sensitive or nonpublic information under applicable law.
