SB316 Summary

• Makes it unlawful for individuals under 21 years of age to purchase, use, possess, or transport electronic nicotine delivery systems and related devices capable of delivering e-liquids, CBD oil, THC oil, herbal extracts, nicotine salts, or other inhalable substances.

• Establishes that a violation occurs upon mere possession of an electronic nicotine delivery system, regardless of whether it contains or was used with any substance.

• Exempts employees under 21 who handle, transport, or sell vaping devices within the scope of employment if a permit holder or supervisor age 21 or older is present.

• Prohibits individuals under 21 from presenting false or fraudulent identification to obtain tobacco, tobacco products, electronic nicotine delivery systems, or alternative nicotine products.

• Requires citing agencies to make reasonable efforts to notify parents, legal guardians, or legal custodians when a minor is cited for violations under the section; became effective the first day of the third month following passage and approval by the Governor.
