AL SB35

Amends Sections 13A-13-7 and 26-23H-4 of the Alabama Code to add exceptions to the abortion prohibition for pregnancies resulting from rape or incest.

Defines rape as sexual intercourse by forcible compulsion, with an incapacitated person, or by someone 16 or older with a person under 12 years old.

Defines incest as sexual intercourse with a related individual including ancestors, descendants, siblings, stepchildren, stepparents, aunts, uncles, nephews, or nieces.

Maintains existing exception allowing abortion to prevent serious health risk to the mother, with confirmation by a second physician within 180 days except in medical emergencies.

Becomes effective July 1, 2023 upon passage and gubernatorial approval or upon otherwise becoming law.
