SB98 Summary

• Removes the requirement for homeowners' associations to file articles of incorporation with the Alabama Secretary of State, eliminating duplicative filing since they must already file articles under nonprofit corporation law.

• Retains requirements for homeowners' associations to file bylaws and other governing documents and original covenants, conditions, or restrictions with the Secretary of State.

• Directs the Secretary of State to maintain a public electronic database organized by association name, searchable through the Secretary of State's website, containing filed documents.

• Authorizes the Secretary of State to adopt rules and collect reasonable fees for implementing the filing and database requirements.

• Becomes effective on the first day of the third month following passage and gubernatorial approval.
