AL HB10

Amends Alabama Code Section 13A-6-3 to add a new manslaughter provision for knowingly selling, furnishing, giving away, delivering, or distributing a controlled substance containing fentanyl, fentanyl mixtures, synthetic fentanyl, or fentanyl analogues in violation of Section 13A-12-211 where the recipient dies as a proximate result of use.

Exempts licensed physicians, pharmacists, and dentists engaged in their respective practices from the new manslaughter provision.

Establishes that it is not a defense to the new provision that the person distributing the controlled substance had no knowledge it contained fentanyl or related substances.

Classifies manslaughter as a Class B felony.

Takes effect immediately upon passage; passed by House on February 22, 2024 and Senate on April 11, 2024.
