HB100 Summary

• Adds Section 13A-5-14 establishing enhanced criminal penalties for crimes committed against election officials when motivated by their role, with minimum sentences ranging from 3 months for misdemeanors to 15 years for Class A felonies.

• Defines "election official" to include absentee election managers, clerks, inspectors, poll workers, registrars, judges of probate and their employees, and the Secretary of State and their employees.

• Allows defendants previously convicted of felonies who receive enhanced sentences under this section to also be subject to the Alabama Habitual Felony Offender Act.

• Amends the Felony Voter Disqualification Act (Section 17-3-30.1) to establish that any felony committed against an election official pursuant to Section 13A-5-14 is a crime of moral turpitude, which disqualifies individuals from voting.

• Becomes effective October 1, 2024.
