Creates a private right of action for a protected class of workers and independent contractors assaulted while performing official job duties, including election workers, health care workers, teachers, retail workers, mail carriers, rideshare drivers, and courthouse staff.

Allows protected workers to recover compensatory damages, punitive damages, and attorney fees in civil court when assaulted or aggravated assaulted during the performance of their duties.

Defines assault as intentional physical injury and aggravated assault as unlawfully inflicting serious bodily injury using a deadly weapon, bodily fluid, chemical substance, or dangerous instrument.

Establishes a two-year statute of limitations for civil actions and eliminates the defense that the actor lacked intent or awareness of the assault.

Provides that criminal conviction under assault laws conclusively establishes liability for civil damages, and the act becomes effective October 1, 2024.
