Adds Section 17-10-2.1 establishing a procedure for counting improperly marked provisional ballots when ballot counters cannot read them.

Permits the canvassing board to attempt determining the elector's choice for any improperly marked office and, with judge of probate approval, mark a new ballot with all elector choices for machine counting.

Adds Section 17-11-10.1 establishing a similar procedure for improperly marked absentee ballots, allowing absentee ballot precinct workers to determine elector's choice with inspector approval and create a replacement ballot.

Requires that if an elector's choice cannot be determined for any office, that office shall not be counted on the ballot, and the original ballot shall be treated as a spoiled ballot and maintained in election records.

Act becomes effective October 1, 2024.
