AL HB279

Establishes the right for Alabama residents to obtain and use contraceptives and for health care providers to dispense FDA-approved contraceptives and provide related information.

Prohibits state and political subdivisions from implementing or enforcing laws that restrict, limit, delay, or impede access to contraceptives or contraceptive information.

Allows the Attorney General, health care providers, and individuals to bring civil suits in circuit court for injunctive relief against enforcement of laws violating these contraceptive access rights.

Permits defendants to assert defenses if a law significantly advances contraceptive safety or health outcomes in a way that cannot be achieved through less restrictive means, or if the law applies equally to medically similar drugs and devices.

Becomes effective October 1, 2024.
