HB31 Summary

• Amends Alabama Code Sections 13A-13-7 and 26-23H-4 to add exceptions to the state's abortion prohibition for pregnancies resulting from rape or incest.

• Permits abortion if an attending Alabama-licensed physician determines it is necessary to prevent serious health risk to the mother, with confirmation by a second physician within 180 days (except in medical emergencies).

• Defines rape to include sexual intercourse by forcible compulsion, with an incapacitated person, or by someone 16 or older with a person under 12 years old.

• Defines incest to include sexual intercourse with ancestors, descendants, siblings, stepchildren, stepparents, aunts, uncles, nephews, or nieces (by blood or adoption, either legitimate or illegitimate).

• Becomes effective October 1, 2024.
