HB363 Summary

• Creates murder charge for operating a motor vehicle in violation of DUI laws (Section 32-5A-191) when causing death if the driver has one or more prior DUI convictions and had 0.15% or more blood alcohol content while driving.

• Establishes manslaughter charge for operating a motor vehicle or vessel in violation of DUI laws (Sections 32-5A-191 or 32-5A-191.3) when causing death of another person.

• Murder under DUI circumstances is a Class A felony; if sentenced to life on a capital offense, defendant must serve minimum of 30 years before parole consideration.

• Manslaughter is a Class B felony.

• Act becomes effective October 1, 2024, and is named the Daryl and Jeanna Speegle and Maggie and Christie Lowe Act.
