Public entities possessing or controlling location monitoring data for defendants on pretrial release must provide that data to law enforcement officers for ongoing criminal investigations where there is reasonable suspicion the data will be probative, without requiring a warrant.

Location monitoring data provided to law enforcement must be limited to data relating to the specific criminal investigation and no more than one year old.

Any location monitoring services contract entered into by law enforcement, corrections, detention agencies, or courts after October 1, 2024, must require contractors possessing location monitoring data to provide that data to law enforcement officers under the same reasonable suspicion standard.

The act becomes effective on October 1, 2024.
