HB6 Summary

• Establishes the Nursing Mother's Act requiring employers to provide reasonable unpaid break time or allow employees to use paid break time or meal time each day to express breast milk.

• Employers must make reasonable efforts to provide a private room or location (other than a bathroom) in close proximity to the work area for breast milk expression.

• Break time should run concurrently with existing break times when possible, and employers are not required to provide breaks if doing so creates undue hardship on operations.

• Prohibits employers from discriminating against employees for choosing to express breast milk in compliance with the law and provides employers with harmless protection if they make reasonable compliance efforts.

• Becomes effective on the first day of the third month following passage and gubernatorial approval.
