AL HB60

Creates the Alabama Adults with Disabilities Protection Act establishing new crimes for abuse, neglect, and financial exploitation of adults with disabilities.

Defines abuse and neglect offenses in three degrees: first degree (Class A felony) for intentional abuse causing serious physical injury; second degree (Class B felony) for intentional abuse causing physical injury or reckless abuse causing serious injury; third degree (Class A misdemeanor) for reckless abuse causing physical injury.

Establishes financial exploitation crimes based on property value: first degree (Class B felony) for amounts exceeding $2,500; second degree (Class C felony) for $500-$2,500; third degree (Class A misdemeanor) for amounts not exceeding $500.

Sets a seven-year statute of limitations for financial exploitation prosecutions beginning from the date of discovery, and allows prosecution in any county where a party to the offense was located.

Becomes effective October 1, 2024.
