HB63 Summary

• Amends Alabama Code Section 15-18-8 to expand split sentencing options for Class A, B, and C felonies with sentences up to 30 years (previously limited to 20 years).

• For sentences greater than 20 years but not more than 30 years, allows judges to order a minimum of 10 years confinement followed by suspension of the remainder and probation, with the minimum period non-suspendable.

• Clarifies that courts retain jurisdiction to suspend remaining minimum sentences and modify probation conditions regardless of whether defendants have begun serving their minimum confinement.

• Maintains prohibition on probation for sex offenses involving children that constitute Class A or Class B felonies.

• Effective October 1, 2024; passed House 60-34 with 5 abstentions on April 23, 2024.
