AL HB85

Creates the Marion County Service of Process Fund to be maintained and audited by the county commission.

Authorizes the Marion County Sheriff to contract with private, public, or governmental entities for service of process on documents other than arrest warrants.

Imposes a $30 per document service of process fee in both criminal and civil divisions of Marion County district and circuit courts, collected by clerks, sheriffs, or appropriate court officials and paid into the fund.

Allows the Marion County Commission to use fund revenues at its discretion for any lawful purpose, provided the monies do not diminish or replace other county income sources.

Becomes effective October 1, 2024.
