HB93 Summary

• County commissions are not liable for and may not be named as a party to lawsuits challenging the expenditure or use of public funds when a local law authorizes a single public official to expend, award, or use those funds at their discretion.

• Damages and litigation costs from such lawsuits may not be recovered from county commission funds.

• The act becomes effective on October 1, 2024.
