SB128 Summary

• Abolishes the State Board of Health, effective September 30, 2024, transferring all powers and duties to the State Committee of Public Health.

• Revises State Committee of Public Health membership composition beginning May 1, 2025, to include physicians appointed by the Medical Association of Alabama and various medical specialty societies, plus four council chairs.

• Changes State Health Officer appointment authority from election by the State Committee to appointment by the Governor from a list submitted by the Committee, with minimum qualifications including full Alabama medical license.

• Requires emergency rules, orders, or directives applicable to the general public to be approved by the Governor and filed with the Secretary of State before taking effect.

• Establishes a review mechanism allowing the Governor, Lieutenant Governor, Speaker, and Senate President Pro Tempore to petition the State Committee to discipline the State Health Officer for exceeding statutory authority by 30 days after written notice.
