SB172 Summary

• Prohibits employers with five or more employees from discriminating against applicants or employees based on hair texture or hairstyle commonly associated with a particular race, ethnicity, or national origin, including afros, braids, locks, twists, cornrows, bantu knots, and fades.

• Protects individuals from retaliation by employers for enforcing hairstyle protections, testifying in proceedings, or participating in investigations related to discrimination claims.

• Allows individuals to bring civil actions against employers for violations, with courts able to award back wages, benefits, liquidated damages if willful, attorney fees, and expert witness fees.

• Prohibits discrimination based on hair texture or hairstyle in programs or activities receiving state or federal financial assistance.

• Becomes effective October 1, 2024.
