SB235 Summary

• Amends Section 12-15-134 of the Alabama Code to strengthen protections for juvenile law enforcement records by restricting disclosure of photographs, likenesses, and personal identifying information prior to conviction.

• Prohibits publication of juvenile records in printed or electronic media and restricts public inspection unless a hearing under Section 15-13-3 is held, probable cause is determined by a judge, an indictment is issued, or the court orders release for specific interests.

• Establishes that any person who knowingly discloses, uses, or permits use of information identifying a child or their family under juvenile court jurisdiction is guilty of a Class A misdemeanor upon conviction.

• Permits counsel and prosecuting authorities to disclose confidential law enforcement records as needed to investigate, prosecute, or defend cases, provided the disclosure is in furtherance of those proceedings.

• Becomes effective June 1, 2024.
