SB276 Summary

• Increases mandatory medical cannabis licenses issued by Alabama Medical Cannabis Commission from 4 to 6 processor licenses, from 4 to 7 dispensary licenses, and from 5 to 15 integrated facility licenses.

• Voids any rescission or denial of licenses for applicants who received awards on June 12, 2023, August 10, 2023, December 1, 2023, and December 12, 2023, and requires the commission to reissue those licenses by June 15, 2024.

• Establishes an administrative adjudicatory process with an administrative law judge to consider remaining applicants for any additionally available licenses, with hearings to begin within 45 days and conclude within 90 days.

• Creates an appeals process allowing aggrieved applicants to appeal final commission orders directly to the Alabama Court of Civil Appeals within 21 days, with the Court of Civil Appeals having no discretion to refuse timely filed appeals.

• Becomes effective June 1, 2024.
