Classifies unlawful sale of a controlled substance (excluding marijuana) as a violent offense not subject to presumptive sentencing guidelines, while furnishing, giving away, or delivering controlled substances remains nonviolent.

Excludes marijuana from the unlawful distribution of controlled substances statute and creates a separate crime of unlawful distribution of marijuana as a Class B felony.

Changes mandatory five-year consecutive sentences for drug distribution near schools or public housing projects to discretionary penalties that judges may impose.

Adds sale of a controlled substance pursuant to Section 13A-12-211(a)(1) to the list of violent offenses defined in the sentencing guidelines.

Becomes effective October 1, 2024.
