SB89 Summary

• Amends Alabama Code Section 13A-11-9 to expand the crime of loitering to include remaining on a public state roadway, its right-of-way, or any area within 30 feet of an interchange involving a controlled-access or limited-access highway.

• Establishes that loitering is a violation; a second or subsequent violation in the same jurisdiction is a Class C misdemeanor.

• Requires law enforcement officers to instruct violators to immediately and peaceably exit the roadway or right-of-way prior to making an arrest for roadway loitering violations.

• Allows officers to offer transportation to emergency housing for persons in initial violation of roadway loitering provisions, subject to acceptance by the person.

• Becomes effective June 1, 2024.
