SB95 Summary

• Amends Section 28-11-13 of the Code of Alabama 1975 to prohibit individuals under 21 years of age from purchasing, using, possessing, or transporting tobacco, tobacco products, electronic nicotine delivery systems, or devices capable of delivering e-liquid, CBD oil, THC oil, herbal extract, nicotine salt, or similar substances.

• Makes possession of such devices illegal for minors regardless of whether the device contains any substance or which particular substance, if any, is present in the device.

• Exempts employees under 21 who work for permit holders from the prohibition when acting within their employment scope and when a supervisor 21 or older is present.

• Prohibits minors from presenting false or fraudulent identification to obtain tobacco products or electronic nicotine delivery systems.

• Requires citing agencies to make reasonable efforts to notify a parent, legal guardian, or legal custodian when a minor is cited under this section, and exempts medical devices prescribed by licensed physicians from the prohibition.

• Becomes effective October 1, 2024.
