SB97 Summary

• Creates a new crime of "criminally negligent storage of a firearm" for storing or leaving a loaded firearm in a location where a minor is likely to gain access, if the individual knows or reasonably should know of the minor's likely access.

• Classifies criminally negligent storage of a firearm as a Class C felony.

• Excludes firearms stored with a gun lock or carried on the person of an individual from the prohibition.

• Defines "loaded" as a firearm with ammunition in its chamber or magazine (if magazine is in the firearm), unless the firearm is incapable of being fired.

• Becomes effective October 1, 2024.
