HB295 Summary

• Amends Sections 31-2A-15 and 31-2A-19 of the Alabama Code relating to military discipline and non-judicial punishment within the Alabama National Guard.

• Clarifies that brigade or battalion level commanders (Army) or wing/group/base commanders (Air) may impose disciplinary measures on enlisted members E-6 and below, including reductions to the next inferior pay grade, and enlisted members E-4 and below to any pay grade.

• Expands authority of the Governor, Adjutant General, general court-martial convening authority, or general or flag rank officers to impose reductions of not more than two pay grades on enlisted members E-5 through E-9.

• Modifies special courts-martial authority to reduce soldiers or airmen in ranks E-6 through E-9 down to E-1, and allows reduction of E-7 through E-9 personnel to E-4; officers may be reduced to the highest rank where they last served honorably.

• Becomes effective October 1, 2025.
