HB320 Summary

• Amends Alabama Code Section 39-2-2 to require public works contracts over $100,000 to be advertised on a centralized website maintained by the Department of Finance, in addition to traditional newspaper publication requirements.

• Allows municipalities with no local newspaper to satisfy advertising requirements by posting notice on a bulletin board and sending notices by U.S. mail or electronic mail to persons on a solicitation list, or by publishing on the Department of Finance centralized website for at least seven consecutive calendar days.

• Permits the Department of Transportation and counties to satisfy advertising requirements through alternative methods: ALDOT may use its publicly accessible website for three weeks, and counties may follow procedures approved by the Association of County Engineers of Alabama and the Department of Examiners of Public Accounts.

• Establishes a Study Commission on Public Notice of Title 39 Advertisements comprising 12 members from state agencies, educational institutions, and construction industry organizations to study and recommend improvements to the centralized website notice system by the 2026 legislative session.

• Section 1 effective October 1, 2025; Section 2 effective June 1, 2025.
