Amends Section 45-57-83.40 of the Code of Alabama 1975 to modify the probate recording fee structure in Russell County.

Maintains the base recording fee of $5 per instrument filed in probate court or marriage license issued, with the county commission authorized to increase the fee up to $10 by resolution.

Requires recording fees to be deposited in a separate account managed by the judge of probate and accumulated for modernizing probate office records and record-keeping.

Allows fees to be used to offset general probate office operating costs only if the judge of probate declares funds to be in excess of modernization needs.

Effective October 1, 2025, with fees subject to auditing by the Department of Examiners of Public Accounts and controlled solely at the judge of probate's discretion.
