AL HB38

Adds Sections 12-17-184.1 and 12-17-184.2 to the Code of Alabama 1975 regarding prosecuting attorney duties and legislative findings on prosecutorial functions.

Declares that prosecuting attorneys should be able to provide advice to law enforcement officers upon request on matters of criminal procedure, civil procedure, criminal charges, criminal investigations, and other legal matters within their scope of authority.

Establishes that free and unfettered discussions between prosecuting attorneys and law enforcement officers during the investigation and charging process are essential to fair and just application of Alabama criminal laws.

Designates a prosecuting attorney's provision of legal advice to law enforcement officers on criminal procedure, civil procedure, criminal charges, or criminal investigations as a vital prosecutorial function and inherent part of prosecution within the attorney's scope of authority.

Becomes effective immediately upon enactment; passed by the House on February 11, 2025 and the Senate on May 6, 2025.
