HB403 Summary

• Amends Section 13A-6-260 of the Code of Alabama 1975 to add "ALEA" (Alabama State Law Enforcement Agency) definition and reorganize existing definitions related to criminal enterprises, firearms, and weapons.

• Creates a new Section 13A-6-264 establishing the Alabama Criminal Enterprise Database as a statewide inter-jurisdictional criminal intelligence system to be managed by ALEA subject to funding availability.

• Authorizes any criminal justice agency to submit information about persons reasonably suspected of criminal conduct for inclusion in the database if the information is relevant to identifying criminal enterprise members or enterprises.

• Restricts access to database information to criminal justice agency personnel for legitimate law enforcement purposes, with limited exceptions for court orders, discovery requests, and subpoenas, and designates database information as confidential and not subject to public disclosure.

• Requires the Secretary of ALEA to adopt rules establishing a uniform digital submission process, usage guidelines, civil penalties for violations, and standards ensuring compliance with federal Criminal Intelligence Systems Operating Policies (28 C.F.R. Part 23); effective June 1, 2025.
