HB481 Summary

• Amends Section 39-2-2 of the Code of Alabama 1975 to exempt the purchase and installation of certain materials and equipment by local boards of education and certain public procurement units from public works contracting procedures.

• Allows eligible entities to purchase and install materials or equipment under specific statutory provisions (Section 41-4-170 et seq., Section 41-16-51(a)(14)-(19), or Section 16-13B-2(a)(13)-(15)) without following standard public works bidding requirements.

• Requires installations exempt from bidding to meet multiple conditions: design professional plans when required, code compliance, bonding requirements, competitive bidding approval by the Department of Examiners of Public Accounts, and use of Alabama-licensed contractors.

• Specifies that remaining portions of public works projects must still comply with standard contracting requirements even if the exempt material installation reduces the project below the $100,000 threshold.

• Becomes effective October 1, 2025.
