• Limits liability of off-roading park operators for injuries or deaths of participants resulting from inherent risks of off-roading, with exceptions for operator negligence, willful/wanton disregard, intentional injury, faulty vehicles, and dangerous latent conditions.

• Operators must post clearly visible warning signs with 1-inch minimum black letters and include warning language in all written contracts for off-roading activities.

• Operators lose immunity protections if they fail to post required warning signs and include warning notices in contracts.

• Operators must maintain liability insurance coverage of at least $1,000,000 per occurrence and $2,000,000 in aggregate to be eligible for immunity, with proof available for inspection upon request.

• Act becomes effective October 1, 2025.
