Director of Transportation must obtain estimated cost of utility relocation and include the estimate in any request for federal participation or other federal funding for highway construction projects.

Expands definition of "utility" to include providers of electricity, gas, water, sewer, broadband, cable, and telecommunications services at retail or wholesale levels, as well as publicly, privately, and cooperatively owned utilities.

Prohibits Department of Transportation from charging fees for the use or placement of utilities on state rights-of-way.

Amends Sections 23-1-5, 23-1-45, and 23-2-146 of the Code of Alabama 1975 to establish procedures for relocation of public, private, and cooperative utility facilities associated with highway, road, or street construction.

Act becomes effective October 1, 2026.
