HB611 Summary

• Prohibits internet service providers, cell phone service providers, and content delivery networks from accepting or forwarding HTTP requests to applications that permit obtaining abortion-producing drugs for delivery in Alabama.

• Prohibits persons offering abortion-producing drugs from enrolling Alabama residents as customers in information technology systems that facilitate obtaining such drugs, and prohibits various technology and payment providers from facilitating their sale or delivery.

• Requires internet service providers and cell phone service providers to block six specified domain names (aidaccess.org, heyjane.co, plancpills.org, mychoix.co, justthepill.com, carafem.org) and any additional domains identified by the Attorney General.

• Establishes criminal penalties of Class C felony for first violations and Class B felony for subsequent violations by service providers; Class A felony if abortion results from drug use, Class C felony otherwise for drug providers; authorizes Attorney General civil actions with $10,000 fines per offense, with 50% of fines deposited to the Attorney General's operating account and 50% funding grants to Alabama Pregnancy Resource Centers.

• Provides affirmative defenses if defendants were unaware of unlawful use and promptly blocked access; grants immunity to service providers for restricting access to abortion-producing drugs; allows women who received the drug, their spouses, children, parents, or siblings to sue for wrongful death of an aborted child; effective October 1, 2025.
