HB91 Summary

• Amends sections 24-1-61 and 24-1-66 of the Code of Alabama 1975 to expand powers of county housing authorities and add new definitions including "mixed-use project" for developments with multiple uses.

• Grants county housing authorities new powers to participate in business organizations, create subsidiaries, make loans, enter design-build contracts, and manage housing projects, community facilities, or mixed-use projects regardless of ownership.

• Establishes that corporate subsidiaries wholly owned by housing authorities and meeting specific criteria constitute governmental entities subject to tort liability limitations under Chapter 93 of Title 11.

• Exempts county housing authorities and their property, income, bonds, and related conveyances from all state taxes; allows authorities to be exempted from local taxes if approved by local governing body resolution.

• Validates all business entities created by housing authorities before June 1, 2025, and becomes effective June 1, 2025.
