SB123 Summary

• Amends Section 41-9-655.03 of the Code of Alabama 1975 to modify reporting requirements for civil asset seizures and forfeitures by the Alabama Justice Information Commission.

• Requires the Alabama Justice Information Commission to submit an annual written report by February 1 to the Speaker of the House, President Pro Tempore of the Senate, and Governor containing a summary of seizure and forfeiture activity, property types and values, and proceeds received.

• Mandates that aggregate reports be published on the Alabama Justice Information Commission website and must include all civil case numbers assigned in state court.

• Allows the commission to disaggregate seizure and forfeiture data and include recommendations to improve laws, rules, and policies ensuring fair treatment of crime victims, innocent property owners, secured interest holders, citizens, law enforcement, and taxpayers.

• Becomes effective on October 1, 2025.
