SB238 Summary: Kinston Speed Limit Safety Act

• Authorizes the Town of Kinston, Alabama to use automated photographic speeding enforcement systems to detect and record violations exceeding 10 mph over posted speed limits as civil (non-criminal) violations.

• Establishes civil fines up to $100 plus $10 court costs per violation, with vehicle owners presumptively liable but able to contest in Kinston Municipal Court within 15 days of notice.

• Requires the town to mail violation notices by certified mail within 30 days of offense, post warning signs at entry points and near cameras, and conduct public awareness campaigns 30 days before system activation.

• Grants Kinston Municipal Court jurisdiction over civil violations with appeals to Coffee County Circuit Court for trial de novo; violations cannot result in criminal penalties, jail time, or affect driving records or insurance rates.

• Prohibits civil penalties if the vehicle operator was simultaneously arrested or cited by police for criminal speeding; takes effect October 1, 2025.
