Establishes the crime of aggravated theft of employee retirement benefits, making it illegal to embezzle, steal, or unlawfully convert monies, funds, premiums, credits, or other assets due to employee retirement benefit plans.

Applies to plans under Alabama's Retirement Systems including the Teachers' Retirement System, Employees' Retirement System, and Judicial Retirement Fund, as well as plans established under Chapter 27A or 27C of Title 36.

Provides an affirmative defense if an individual acts in good faith reliance upon direction or supervision of another under color of law or in a position of authority during their employment.

Sets the statute of limitations at six years, beginning from discovery of the deceptive facts, and classifies the offense as a Class C felony with a maximum probation period of 10 years.

Treats convictions as Class A or Class B felonies for sentencing purposes under Section 15-18-8, and becomes effective October 1, 2025.
