The Attorney General or Governor, in consultation with each other, may appoint an interim police chief to a municipal police department if a particular and ongoing threat to public safety exists after reviewing federal, state, and local crime statistics, determining law enforcement staffing has declined 30% or more from the 10-year average, and consulting with the district attorney, county sheriff, and crime victims.

The interim police chief serves at the pleasure of the appointing authority, not subject to the mayor or city council, and shall serve until the Attorney General or Governor determine the public safety threat no longer exists.

The interim police chief's salary is paid from the appointing authority's operating account at the appointing authority's discretion; if a sheriff is appointed, additional compensation cannot exceed $75,000 per year.

The appointing authority may petition circuit court to recover all costs incurred if the court finds the appointment requirements were satisfied; the interim police chief is considered a state officer.

Municipalities with an interim police chief must continue funding the police department at amounts commensurate with the five-year average preceding the appointment and maintain agreements necessary to sustain prior operational levels, or face suspension of state funds, grants, and appropriations.
