SB322 Summary

• Amends Alabama Code Sections 35-8B-1 and 35-8B-2 to authorize annexation of certain community development districts by wet municipalities in the same county upon petition by the district's board and approval by the municipality's governing body.

• Annexation does not require contiguity between the district property and the annexing municipality, and requires at least 30 days' notice to the judge of probate prior to approval.

• Establishes a new category of community development district in dry counties with one or more wet municipalities, with requirements including at least 500 acres, a hotel/lodge with 100+ rooms, 18-hole golf course, marina with 50+ boat slips, clubhouse, restaurants, and conference center.

• Property within an annexed community development district cannot be used as a casino site or for commercial or charitable gambling activities, and annexation must commence by June 1, 2026.

• Becomes effective October 1, 2025.
