Sheriffs and county commissions or local police chiefs and city councils may contract with nonpublic schools (private, church, parochial, religious, or homeschooling entities) to provide school resource officers as defined in Section 16-1-44.1, Code of Alabama 1975.

Contracts may only be approved if school resource officer services are available to every public school system in the county or municipality where the contracted service would be provided, and remain valid only as long as this requirement is met.

Nonpublic schools must fully reimburse the county commission or city council for the full salary, benefits, and all other costs associated with each school resource officer provided under the contract.

Nonpublic schools must provide occurrence-based liability insurance as primary coverage in an amount no less than the county or city's coverage, naming the county, sheriff, deputies, or municipality, police chief, and officers as additional insureds; failure to maintain coverage requires the school to assume all liability for the officer's actions.

Off-duty law enforcement officers may contract with nonpublic schools in their personal capacity, and sheriffs or police chiefs may provide security, traffic control, and similar services at nonpublic school properties; the act becomes effective June 1, 2025.
