SB46 Summary

• Amends Section 22-40A-12 of the Code of Alabama 1975 to authorize Class 2 municipalities to request enforcement authority and establish delegation agreements with the Alabama Department of Environmental Management for the Scrap Tire Environmental Quality Act.

• Grants municipal courts in Class 2 municipalities jurisdiction over violations of the Scrap Tire Environmental Quality Act.

• Establishes specific criminal penalties for violations in Class 2 municipalities: Class C misdemeanor for accumulating scrap tires in violation, Class B misdemeanor for processing violations, and Class A misdemeanor for transportation violations.

• Requires entities with delegation agreements to provide quarterly reports to the department, written investigation reports within 10 days, investigate complaints regarding scrap tires, investigate illegal dumping, and review manifests at businesses.

• Effective date: June 1, 2025.
