SB5 Summary

• Restructures the Board of Trustees of the Department of Archives and History to consist of one member from each U.S. Congressional District (7 districts), nine at-large members, and the Governor or designee, with congressional districts fixed as they existed on January 1, 2025.

• Establishes a detailed vacancy-filling process where the Governor appoints members from Congressional Districts 1-7, while the Speaker of the House of Representatives and President Pro Tempore of the Senate appoint the nine at-large members, with staggered six-year terms commencing between 2025 and 2030.

• Requires Seat 9 (Speaker appointment) and Seat 15 (Senate President Pro Tempore appointment) to be filled from three nominees provided by the respective chamber's Minority Leader.

• Mandates appointing authorities coordinate appointments to ensure board membership reflects the state's racial, gender, geographic, urban, rural, and economic diversity.

• Applies retroactively to January 1, 2025, and becomes effective immediately upon passage.
