SB63 Summary

• Requires law enforcement agencies to collect a full set of fingerprints and a DNA reference sample from any illegal alien in custody before release, unless previously collected.

• Mandates submission of collected fingerprints to the Alabama State Law Enforcement Agency for cataloging and DNA samples to the Alabama Department of Forensic Sciences for analysis and database entry.

• Amends definition of "illegal alien" to mean an alien not lawfully present in the United States under any federal law, regulation, order, or directive.

• Increases court fees for criminal cases from $12 to $15 per case, with portions allocated to the Alabama DNA Database Fund ($14 for fiscal year 2026 and thereafter) and Citizenship Trust ($1).

• Effective date: June 1, 2025.
