SB93 Summary

• Prohibits pharmacy benefits managers from reimbursing pharmacies less than the actual acquisition cost of drugs plus a professional dispensing fee at least equal to Alabama Medicaid rates.

• Prevents pharmacy benefits managers from charging pharmacies miscellaneous fees for network participation, credentialing, claims submission, or processing unless conducted as part of an audit.

• Permits pharmacists to disclose to patients information about drug costs, reimbursement amounts, and clinical efficacy of more affordable alternative medications without penalty.

• Allows pharmacies to refuse dispensing drugs when reimbursement falls below their dispensing costs, and prohibits PBMs from retaliating or imposing penalties for such refusals.

• Authorizes the Commissioner of Insurance to enforce violations of pharmacy benefits manager regulations during pharmacy audits and to investigate complaints by auditing entities licensed under Title 27, effective October 1, 2025.
