Amends Section 36-22-64 of the Code of Alabama 1975 to allow sheriffs who independently qualify for both a supernumerary sheriff program and the Employees' Retirement System to participate in both programs, provided qualification is based on separate years of service

Prohibits participation in both programs when based on the same years of service

Requires sheriffs eligible for multiple retirement plans to elect which plan(s) to participate in and notify the proper authority within 60 days of becoming eligible for payments

Passed the Alabama House of Representatives on March 3, 2026, with 101 yeas, 0 nays, and 4 abstentions

Effective date: October 1, 2026
