AL HB409

Authorizes the City of Alabaster to designate an enforcing official to identify plant-related public nuisances and order property owners to abate them within 14 days (or up to 28 days for difficult cases)

Property owners may request a hearing before a separate administrative official to contest the nuisance determination; owners have 10 days to appeal unfavorable decisions to circuit court

If owners fail to abate the nuisance after proper notice and any appeals, the city may enter the property and perform the abatement work itself or contract for the work

Abatement costs (labor, equipment, administrative and legal expenses, materials) become a "weed lien" on the property, added to property tax bills and collected like municipal ad valorem taxes

Effective October 1, 2026
