Residential home builders must disclose in writing to homeowners whether they have liability insurance before starting construction, which may be included in the contract or as a separate addendum

Builders who have liability insurance can satisfy the disclosure through signatures or initials (electronic or otherwise) from the builder and homeowner, with no witness required

Builders who do not have liability insurance must have the disclosure signed by both parties and attested by one witness selected by the homeowner

Failure to comply constitutes a violation punishable by the Home Builders Licensure Board under Section 34-14A-8
