Amends Section 11-43-2 of the Alabama Code to allow mayors in cities and towns with an even number of council seats to vote as a tie-breaking member of the council, if the local governing body adopts a resolution authorizing this power

Cities with populations of 12,000 or more currently prohibit mayors from sitting with or voting in council proceedings; this bill creates an exception for tie-breaking votes in municipalities with even-numbered councils

Cities with populations under 12,000 continue to have legislative functions exercised by the mayor and five aldermen, with the mayor able to vote on any question and required to vote in case of a tie

Passed the Alabama Senate unanimously (29-0) on January 21, 2026
